Filing a DMCA Takedown Notice
To be valid under the DMCA (17 U.S.C. § 512(c)(3)), your notice must include:
Your physical or electronic signature.
Identification of the copyrighted work claimed to be infringed.
Identification of the material that is claimed to be infringing and information sufficient to locate it (e.g., a URL).
Your contact information (address, phone, email).
A statement that you have a good-faith belief the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Skillazo will respond to valid notices by removing or disabling access to the allegedly infringing content.
Counter-Notice Procedure
If you believe your content was removed in error, you may submit a counter-notice to the DMCA agent listed above. A valid counter-notice must include:
Your physical or electronic signature.
Identification of the content that was removed and where it appeared before removal.
A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
Your name, address, and phone number, and a statement consenting to the jurisdiction of the federal district court for your address, and that you will accept service of process from the person who filed the original notice.
If a valid counter-notice is received, Skillazo may restore the content unless the original copyright owner files a court action within 10 business days.
Repeat Infringer Policy
It is Skillazo’s policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who are repeat infringers.
A “repeat infringer” is any user who has received multiple valid DMCA takedown notices regarding their uploaded content.
Upon receiving a valid notice, Skillazo may remove or disable access to the infringing content.
Users who repeatedly infringe may have their accounts suspended or terminated.
Skillazo may also restrict access for users who are subject to repeated valid complaints, even if they do not strictly qualify as repeat infringers.
